Motorcycle Accidents

Many motorcycle enthusiasts enjoy riding a motorcyle because it provides an open view of the road.  However, this same positive attribute can be a negative when it comes to safety.  Since motorcyles lack the rigid external cage of cars, they offer their operators little protection in a crash.  They travel at fast speeds and they are lighter than passenger vehicles so they suffer more damage when struck.  Open to the elements, motorcycles are particularly dangerous to operate in rain, sleet, and snow.

In the last ten years, motorcycle crash rates have skyrocketed.  From 1997 to 2006, the number of motorcycle crashes increased an estimated 61 percent.   What is more, accidents are more likely to be fatal.  Motorcycle fatalities have increased from 2,028 in 1997 to 4,654 in 2006, accounting for a 129-percent increase.  The National Highway Traffic Safety Administration (NHTSA)’s national accident data  indicates that per vehicle mile, motorcyclists are about 32 times more likely than passenger car occupants to die in a traffic crash.  In Alabama alone, there were 74 motorcycle rider fatalities in 2004 according to the NHTSA’s Alabama accident data.

A report from the NHTSA shows that most incapacitating and fatal injuries were sustained when the initial point of impact was the front of the motorcycle.  Lower-extremity injuries were the most commonly sustained injuries.  While less common, upper-extremity injuries, such as those to the head, chest and abdomen tend to be more severe.

The mental anguish associated with a terrible injury can be devastating.  While recovery may be frustratingly slow, you may be able to find some comfort or relief in receiving a monetary award for the pain and suffering.

In addition to the actual trauma of a severe motorcycle accident, there are significant costs incurred for medical treatment.  You are likely looking at tens of thousands of dollars in medical treatment expenses.   As Attorney David Selby knows, most insurance companies are unlikely to pay hospital expenses without a fight.

After a no-fee consultation, he will tell you whether it is possible to recover costs associated with motorcycle accident medical and recovery costs by holding a reckless driver accountable for his irresponsible action.  If injuries sustained in an accident were fatal, one’s spouse and children may benefit from a wrongful death lawsuit.

While financial award may not be a motivating factor for you or your family, pursuing a lawsuit may make it that much more likely that a negligent driver refrains from repeating irresponsible behavior the next time they get behind the wheel.

David Selby can handle your motorcycle accident lawsuit in Birmingham, Montgomery, Tuscaloosa, Anniston, Gadsden, Mobile, Dothan, Huntsville, Florence, Pell City, Auburn/Opelika, Andalusia, Fort Payne, and Selma, Alabama.
